Scott Krichbaum ruled that Zorger blood alcohol test and statements made to police were in admissable because a prosecutor no longer on the case failed to call witnesses at the hearing.On Thursday, two of three charges against Zorger were dismissed as part of a plea agreement and prosecutors say it likely they would have faced issues in proving those charges.Zorger pled guilty to a single count of aggravated vehicular homicide in the death of the Beaver Township woman, but a vehicular homicide charge and one count of child endangering were dismissed in connection with the death of Zorger fetus.Prosecutor Rebecca Doherty told the judge, “The state is aware that one of the issues that could come up pertaining to those counts is the defendant own conduct as far as any alcohol consumption and cigarette smoking that perhaps caused the baby weight to be as small as it was upon its death.”Doherty said there was contradictory opinons on the viability of the fetus and if the baby could survive outside of the womb, which quite possibly could have made it difficult to convict Zorger on those charges.Zorger was about six months pregnant when investigators say she caused the head on crash in April.
